First individual horizon victims to sue the post office
Former sub-postmaster Lee Castletton is initiated legal action against Post Office and Fujitsu, who has become the victim of the first individual horizon IT scam to sue two organizations.
His case is one of the highest profiles in the scam in which hundreds of sub-postmasters of defective software were incorrectly convicted, as he said the money was missing from his branch accounts.
Mr. Castletton is demanding compensation, alleging that the civil decision against him was obtained by fraud.
“I want justice and want to be publicly dismissed,” Mr. Castleton told the BBC. The post office and Fujitsu have been contacted for comment.
On Tuesday, Mr. Castletton directed his Soulster, Simmons Muirhead Burton to issue proceedings against the post office and Fujitsu in the High Court on their behalf.
While other victims have seen their defects turning around, the civil decision of Sri Castleton is still standing against them. Their legal action is to separate the decision on one side, or to overturn.
“I would like to effectively do my day in court,” Mr. Castleton said that the next month is to get his OBE.
He told the BBC that he had very little confidence in compensation plans, the post office has incorrectly established to compensate the guilty sub-postmasters to be heard in court.
Mr. Castletton never started the compensation plan process, although he has received an interim payment.
He says that he wanted to take action to help other victims fight for his compensation.
In 2007, Mr. Castletton lost a two -year legal battle against the post office, as he filed a lawsuit to recover a cash of 25,000 pounds, allegedly missing from his branch in Brijingon in East Yorkshire.
When his legal insurance ran away, Mr. Castleton had to represent himself in the court and landed in legal costs with a bill of £ 321,000, which he could not pay and declared bankruptcy.
“Now we know from the post office investigation that he wanted to create an example of me,” he said.
“Lee faced a David vs. Goliat’s fight against the post office and we are fully prepared to take it in the High Court, we need us.”
During a public investigation, it was revealed that the log of Fujitsu’s known errors was not told to Mr. Castleton during his court proceedings.
The application for the court in Lee’s case would say that the post office, conspiring with others, withdrew evidence about the incredibility of the horizon system. A witness from Fujitsu also gave evidence in his case.
“We are going to effectively say that there was an abuse of the claim process against him. It was never about the recovery of money – it was to create an example of Sri Castletton” Saying “Sri Goldberg.
“We also believe that the decision was obtained by fraud that the post office and Fujitsu fully knew that the horizon system was not working properly,” he said.
